TERMS OF THE MARKETCAT.APP WEBSITE AND STORE

These terms govern how the MarketCat website and store at https://marketcat.app operate, including the provision of services by electronic means, the sale of SaaS subscriptions and plugins, and the use of modules based on artificial intelligence (AI).

§ 1. General provisions and definitions

  1. Właścicielem i administratorem serwisu marketcat.app (zwanego dalej: „Serwisem”) jest JFK DESIGN, z siedzibą w Chorzowie, ul. Wieniawskiego 18, 41-506 Chorzów, NIP: 6271824348, e-mail kontaktowy: support@marketcat.app (zwany dalej „Usługodawcą” lub „Administratorem”).
  2. User / customer – any natural person, legal person or organisational unit using the site, including when buying products or subscriptions. The site is aimed mainly at businesses (B2B).
  3. Product – the software available on the site (for instance WordPress/WooCommerce plugins such as MCat Source), licences, digital materials or access to SaaS applications (software as a service).
  4. Subscription – a service provided electronically on a subscription model (the Standard and PRO plans, for instance), consisting of recurring access to analytics or audit tools (MarketCat AI Ads Auditor).

§ 2. Types and scope of the services provided

  1. Through the site the provider delivers the following services:
    1. Sale of access to analytics tools for e-commerce.
    2. Sale of access to audit tools based on artificial intelligence (MarketCat AI Ads Auditor).
    3. Provision of free and paid plugins for third-party software.
  2. Using the site requires a device with internet access and authorisation through Facebook Login (OAuth) for those modules that need access to the Meta Ads API.

§ 3. Contract, payments and subscriptions

  1. The prices of all products and subscriptions shown on the site include tax.
  2. Recurring payments: By choosing a subscription plan the user agrees to charges being taken automatically according to the price list until the subscription is cancelled.
  3. The user can cancel the subscription at any time in the client panel. No refund is due for the unused part of the period already paid for.

§ 4. Copyright and licences

  1. All products, plugins, algorithms and texts on the site are the property of the provider and are protected by copyright.
  2. Reselling, decompiling or unlawfully copying the tools provided is prohibited.

§ 5. Detailed rules and disclaimer for the “MarketCat AI Ads Auditor”

Given the particular nature of a tool based on machine learning (AI), the user accepts the following conditions:

  1. The nature of the tool: The tool is analytical, advisory and educational in nature only. It is designed to support decision-making through automatic analysis of data.
  2. No guarantee of results: The administrator in no case guarantees that particular financial results (a higher ROAS or a lower CPL, for instance) will be achieved by following the recommendations generated by AI.
  3. Risk and independence of decisions: All suggestions (“switch off” or “scale”, for instance) are merely a mathematical interpretation of the data. The final decision on making changes in the ad account rests 100% with the user.
  4. Limitation of liability: The administrator is not liable for:
    1. financial losses arising from acting on the tool’s suggestions.
    2. the actions of third parties (an account being blocked by Meta or Google, for instance).
    3. errors, so-called “AI hallucinations” or misinterpretation of data arising from the nature of language models.

§ 6. Limitation of liability for software and plugins

  1. The provider is not liable for failures arising from changes to the APIs of third parties (Meta, Google, WordPress).

§ 7. Withdrawal from the contract (returns)

  1. By law there is no right of withdrawal for the supply of digital content once performance has begun with the user’s express consent (generating the first audit or downloading the plugin).

§ 8. Complaints

  1. Reklamacje można składać mailowo na adres: support@marketcat.app. Administrator rozpatruje je w terminie 14 dni.

§ 9. Final provisions

  1. The contracts are governed by Polish law.
  2. The administrator reserves the right to change these terms and will inform users by e-mail.
